- 12/1/2010 - Laser Response regarding PA ALJ recommendations on LNGC's Application for a Certificate of Public Convenience
On January 19, 2010, Laser Northeast Gathering Company filed an application for a certificate of public convenience with the Pennsylvania PUC. As part of the review process, the PA PUC assigned an administrative law judge to review LNGC’s application. On December 1, 2010, the Administrative Law Judge issued recommendations that the PUC disapprove the Joint Petition for Settlement reached between LNGC, the Office of Trial Staff, William Fischer, Vera Scroggins and the Silver Lake Association and deny LNGC’s application.
The judge based her recommendations upon a conclusion that LNGC does not meet the definition of a “public utility” under the applicable statute. The final ruling will be issued by the PA PUC after consideration of the judge’s recommendations and the exceptions and replies filed by the parties to the application. We currently anticipate the final ruling will be issued in January 2011.
LNGC is committed to construct, operate and maintain our natural gas gathering system consistent with the federal safety standards described in 49 C.F.R. Part 192. We believe our application and the Joint Petition for Settlement set forth conditions for the construction and operation of our natural gas gathering system whereby the PA PUC can play an important and appropriate role in protecting public safety in Pennsylvania.
However, the final determination of the PA PUC will have no impact on our ability to construct and operate our Susquehanna gathering system. We remain in high gear moving towards commencing construction once all final permits are received. We expect to be in commercial operations during the second quarter of 2011.

- A General Permit Chapter 105 (Water Encroachment) application has been submitted to the PA Department of Environmental Protection, Oil and Gas Division. Included in this application is a request to cross under the Susquehanna River. The permit is being reviewed.
As part of both the Water Encroachment Permit and the Erosion and Sediment Control Permit (to be submitted soon), notifications were given to the townships affected by the route of the pipeline.
A PNDI (Pennsylvania Natural Diversity Index) review request was submitted to the four agencies to review the pipeline route. Partial approval has been granted.
